Digital Compilation Album Application

I confirm that I am:

 1. An unsigned and independent artist over the age of 18 or an artist under the age of 18 with parental or guardian consent.

2. that I own or otherwise have the legal right to reproduce and distribute the entirety of the Recordings that I am submitting to Sounds On The Couch, including the right to compile these Recordings and release them as part of Albums.

For example, the submitter cannot upload any cover version, remixes or Recordings that include samples unless they have all necessary written permissions from the songwriters and from the owners of said original recordings.

By making this agreement, the submitter indemnifies Sounds On The Couch from any and all claims and damages from third parties related to the Recordings submitted to Sounds On The Couch.

Yes, I agree with the following Royalty agreement:

Calculation of Royalties:

In consideration of this License, Sounds On The Couch shall pay the Licensor a Royalty of 50% net received value pro-rata.

Sounds On The Couch will calculate royalties payable to the Licensor. 

Sounds On The Couch will pay the Licensor once their share of Royalties exceed 20 Dollars (AUD). If the Royalties found to be due do not exceed 20 Dollars (AUD), the sum will be added to the total amount to be paid on a later date and will be payable as soon as the total sum exceeds 20 Dollars (AUD).

Sounds On The Couch will pay Licensor via PayPal. Any transaction costs for payouts are to be paid by the Licensor and will be subtracted from the payable Royalties.

The payout will be automatically paid once royalties exceed 20 Dollars (AUD). It is the Licensor's responsibility to notify Sounds On The Couch of any paypal email address change and back-payments will not be made, should Sounds On The Couch not be notified of this change.

Accounting and Tax:

The Licensor and Sounds On The Couch agree that the Licensor is responsible for its own administration- and payment of any applicable taxes and the Licensor indemnifies Sounds On The Couch against any liability arising in regards to the payment of taxes.

All Royalties shall be calculated inclusive of tax.

Warranties and undertakings of the Licensor:

The Licensor warrants and/or undertakes to Sounds On The Couch that it:
has the right to make this appointment to grant the License contained herein and shall pay all Royalty earning artists whose performances are embodied in the Masters.

Copyright:

If the Licensor does not own nor controls the copyright of the Recordings and Sounds On The Couch is forced to remove these Recordings from all media and platforms the Licensor will:

1. wave all future income.
2. pay back all income from the sold Recordings.
3. compensate Sounds On The Couch with 2000 (two thousand) Dollars (AUD) for each Album that includes this unauthorised Recording
